TRACKTING srl with registered office in Via Borgognina 5, 61030 Cartoceto (PU), VAT number and Fiscal Code registered at the Commerce Register CCIAA PU: IT02036680417 (hereafter denominated, “Data Controller“), owner of the websites www.trackting.com, (hereafter denominated, the “Site“), as responsible for processing the personal data of the Site users (hereafter denominated, the “Users“) informs on its Privacy Policy herein described, pursuant to art. 13 of EU Regulation 2016/679 of 27 April 2016 (hereafter denominated, “Regulation“or “Applicable Regulations“).
This Site and any services offered through the Site are reserved to individuals who have reached eighteen years of age. Therefore, the Data Controller does not collect personal data of persons under the age of 18. At the request of the Users, the Data Controller will promptly delete all personal data involuntarily collected concerning persons under the age of 18 years.
The Data Controller stores the personal data concerning the Users in a secure manner and does not sell or transfer this data to third parties.
The Data Controller takes highly prizes the right to privacy and personal data protection of its Users. For any information related to this Privacy Policy, Users may contact the Data Controller at any time, using the following methods:

1. Processing Purpose
The Users’ Personal Data will be processed lawfully by the Data Controller pursuant to Art. 6 of the Regulations for the following processing purposes:
a. Contacting the User via Contact Form. Personal Data submitted in the contact form will be used to communicate with the User exclusively. Personal data collected: Email, Name, Message, IP and navigation data.
b. Completing Sale and Shipment The Personal Data of Users who decide to purchase Trackter will be used in order to:
– Complete the purchase procedure
– Ship the products
– Contact the User for after sales assistance
– Technical communications
Collected Personal Data: Email, Name, Surname, Telephone, Address, Postal code, City, Province, State, and Notes for the dealer.
It is specified that Data related to payment cards are not processed by the Data Controller but by the respective payment services (PayPal, Stripe, or similar services).
c. Social Networks and External Platforms Interactions. This Site enables direct interactions with social networks, or other external platforms. Interactions and information from this Site are in any case subject to the User’s own privacy settings with each social network. Should a social networks interacting service be installed, it is possible that traffic data relating to the pages in which the service is installed may be collected even if the User does not use the service.
d. SPAM Protection. We analyze the Site traffic potentially containing Users Personal Data, in order to separate it from traffic sections, messages and contents recognized as SPAM.
e. Direct Email Marketing (DEM). This Site uses the Users email to send Direct Email Marketing (DEM) advertising to the User if consent was granted to such use.
f. Statistics and Monitoring. The Data Controller monitors and analyzes traffic data and uses them to track User behavior.
– The Site’s internal statistical service stores the access and navigation logs.
Personal Data collected: Usage Data, IP Addresses, and User Agent.
– An external service, Google Analytics, provided by Google Inc. (“Google”) stores access logs and browsing data.
Google uses the collected Personal Data for the purpose of tracking and examining how this Application is used, of compiling reports and sharing them with other services developed by Google. Google may use the Personal Data to contextualize and personalize the advertisements of its advertising network.

g. Administrative and Accounting Purposes, or to carry out activities of an organizational, administrative, financial and accounting nature, such as internal organizational activities and functional activities for the fulfillment of pre-contractual and contractual obligations.
h. Legal Obligations or to fulfill obligations prescribed by the law, an authority, a regulation or European legislation.
Failure to provide the Personal Data indicated as necessary will make it impossible for the User to use the service offered by the Site.
Notwithstanding the provisions of this Privacy Policy, under no circumstances will the Data Controller make the Users’ Personal Data accessible to other Users and / or third parties.

2. Processing Methods and Data Retention Delays
The Data Controller will process the User’s Personal Data via manual and IT tools, for the sole intentional purposes and, in any case, in order to guarantee the security and confidentiality of the Data.

The Personal Data of the Site Users will be kept only for the time required to carry out the primary purposes described in paragraph 1 above, or for the time necessary to lawfully protect, in civil law, the interests of both the Users and the Data Controller.
3. Scope of Communication and Data Divulgation
The User’s Personal Data may be disclosed to Data Controllers’ employees and / or collaborators in charge of operating the Site and the Users requests. These subjects, who have been instructed to do so by the Data Controller pursuant to art. 29 of the Regulations, will process the User’s data exclusively for the purposes indicated in this Policy and in compliance with the provisions of the Applicable Regulations.
The Users’ Personal Data may also be disclosed to third parties who may process personal data on behalf of the Data Controller as “External Processors”, such as, for example, IT and logistic service providers functional to the operation of the Website, outsourcing or cloud computing service providers, professionals and consultants.
Users have the right to obtain a list of data operators appointed by the Data Controller, making a request to the Data Controller as indicated in paragraph 5 below.

6. Further Information on Data Treatment
a. Defense in Court. The User’s Personal Data may be used by the Data Controller in court or in the preparatory stages of his defense against abuse in using this Site or related services perpetrated by the User. The User declares to be aware that the Data Controller may be required to disclose his Data at the request of Public Authorities.
b. Specific Information. For operational and maintenance purposes, this Site and any third party services involved may collect System Logs, which are files that record interactions and may also contain Personal Data, such as User IP address.
c. System Logs and Maintenance to fulfill obligations requested by law, an authority, a regulation or European legislation.
d. Information not Contained in this Policy. More information in relation to our Personal Data processing may be requested at any time to the Data Controller using the contact information.
e. Exercise of the Users Rights. The subjects to whom the Personal Data refer to, at any time, have the right to know whether or not their Data is being detained by the Data Controller, to know its content and origin, to verify its accuracy or request the integration, cancellation, updating, rectification, transformation into anonymous form or blocking of the Personal Data processed in breach of law, as well as to oppose in any case, for legitimate reasons, to their processing. Requests should be addressed to the Data Controller.
This site does not support “Do Not Track” requests. To know if any third-party services involved support them, the User is invited to consult their respective Privacy Policies.
f. Changes to this Privacy Policy. The Data Controller has the right to modify his Privacy Policy at any time by giving notifying the Users on this page. Therefore consult this page often, referring to the date of the last modification indicated at the bottom. In case of non-acceptance of the changes made to this Privacy Policy, the User has to stop using this Site and may request the Data Controller to remove his Personal Data. Unless otherwise specified, the previous Privacy Policy will continue to apply to the Personal Data collected until then.
Pursuant to the Applicable Regulations, the Data Controller informs that Users have the right to obtain indication (i) of the origin of Collected Personal Data; (ii) the processing purposes and methods; (iii) the logic applied in the event of processing carried out with the aid of electronic instruments; (iv) of the identification details of the Data Controller and operators; (v) the subjects or categories of subjects to whom the personal data may be communicated to or who may come to know them as operators or agents.
Furthermore, Users have the right to obtain:

the right to oppose:

b) if they consider the Regulation has been violated in the treatment of their Personal Data, Users have the right to lodge a complaint with a supervisory authority (in the Member State in which they normally reside, in the one in which they work or in the one in which the alleged violation has occurred). The Italian Supervisory Authority is the Guarantor of personal data protection, and is located in Piazza di Monte Citorio n. 121, 00186 – Rome (http://www.garanteprivacy.it/).
The Data Controller is not responsible for updating all links that can be viewed in this Policy, therefore whenever a link is not functional and / or updated, Users acknowledge and accept that they must always refer to the document and / or section of the websites referred to by the link.
